Terms and Conditions

  1. scope of application
    1. These general terms and conditions (GTC) apply exclusively to the business operations of SightQuest. They are binding and apply to all current and future business transactions with its customers, even if no explicit reference is made to them.
    2. Von diesen AGB abweichende oder ergänzende Regelungen -- insbesondere Geschäfts-, Vertrags- oder Einkaufsbedingungen des Kunden -- gelten nur dann, wenn dies von SightQuest ausdrücklich schriftlich bestätigt wird.
    3. SightQuest reserves the unilateral right to amend or update these Terms and Conditions on a regular basis.
    4. For reasons of linguistic simplicity, SightQuest always uses the generic masculine form and does not intend to discriminate against other genders, social groups, or individuals.
    5. The languages of the contract are German and English.
  2. Business purpose, market
    1. SightQuest provides browser-based outdoor quests, puzzle routes, and digital content.
    2. SightQuest erbringt ausschließlich elektronische Dienstleistungen. SightQuest bietet seinen Kunden den Erwerb von Zugangscodes an (in weiterer Folge „Zugangscode"), der in weiterer Folge einen QR Code freischaltet. Dieser QR Code gewährt dem Kunden den Zugang zu unterschiedlichen virtuellen browserbasierten Outdoor-Quests, Rätselrouten, Schnitzeljagden etc. (in weiterer Folge „Quests"), die der Kunde erfolgreich absolvieren kann.
    3. SightQuest provides services to businesses (B2B) and consumers (B2C).
  3. Offer, conclusion of contract
    1. The details of the respective quests are listed on the website and this presentation constitutes a legally binding offer for the customer to conclude a contract.
    2. By making the booking/order, the customer accepts the individual (regional) circumstances of the respective quest. Upon completion of the booking, a contract is concluded between the parties, which is deemed to have been fulfilled in full upon SightQuest transmitting the access code to the customer.
    3. The data, documents, quests, and access codes will be provided exclusively in electronic form. The access code can be redeemed (generation of a QR code) within one year of purchase. After the expiration of the validity period (1 year for access codes, 7 days for QR codes), the redemption claim for completing the quest expires without compensation.
    4. If the customer is a business (B2B), SightQuest reserves the right to agree on individual offers and payment methods. In this case, the customer is bound by the individual agreement, which takes precedence over these General Terms and Conditions in the event of a conflict.
  4. Scope of services, procedure, no right of withdrawal or cancellation
    1. After successful payment, the customer receives a digital code by email. By entering this code on the SightQuest website, a browser-based QR code is generated, which can be scanned to unlock the respective quest.
    2. Legally, the purchased access code or QR code is equivalent to purchasing a ticket to participate in a virtual entertainment event.
    3. The quests can be booked either for individuals or groups. For group bookings, the participation information provided on the website must be observed, and the same conditions apply to group bookings as to individual bookings.
    4. It is recommended to use public transportation or other means of transport to complete the individual sections of the booked quests, as the respective sections are often several kilometers apart.
    5. Für Personen mit eingeschränkter Mobilität können bei der Absolvierung von Quests bzw. einzelnen Abschnitten je nach deren jeweiligen Einschränkungen Beeinträchtigungen auftreten. SightQuest kann -- abhängig der Beeinträchtigungen der jeweiligen Personen -- diesbezüglich jedoch keine Gewährleistung für die subjektive Durchführbarkeit von Quests übernehmen.
    6. From the moment the access code is redeemed, the customer has 7 days to start and complete the quest. After this period, access and the generated QR code will automatically expire. In this case, a refund of the purchase price is excluded.
    7. After redeeming the access code and generating the QR code, access to the respective quest is only possible via the same browser that was originally used to redeem the access code or scan the QR code. It is not possible to re-enter the quest (e.g., via a different device or browser, etc.).
    8. Wird das Browser-Fenster im Inkognito-Modus betrieben und die Quest dort durchgeführt und -- aus welchen Gründen auch immer -- vom Kunden geschlossen, ist ein Wiedereinstieg nicht möglich und verfallen sämtliche Ansprüche des Kunden auf Durchführung der Quest oder Ersatzansprüche entschädigungslos.
    9. Any admission tickets, tickets, etc. (e.g., museums, public transportation, attractions) are not included in the purchase price.
    10. Je nach der gebuchten Quest kann es vorkommen, dass der Kunde Tickets (z.B. für Museen, Sehenswürdigkeiten etc.) zusätzlich erwerben muss, um die im Rahmen des Quests gestellten Rätsel zu lösen. Für den Fall, dass der Kunde dies -- aus welchen Gründen auch immer -- nicht wünscht oder dies (gegenwärtig) unmöglich sein sollte, stellt SightQuest alternative Rätsel bereit, um die gebuchte Quest vollständig zu lösen.
    11. It is hereby noted that this is not a forward transaction. The customer is responsible for informing themselves about the local conditions and completion options for the quest they have booked.
    12. Withdrawal from or revocation of the contract is excluded due to the leisure nature of the services pursuant to Section 18 (1) (10) FAGG.
  5. Mutual rights and obligations
    1. Both parties undertake to cooperate in good faith in the performance of the contract and the provision of the contractual services.
    2. The customer undertakes to inform SightQuest immediately via the support information published on the Internet of any malfunctions, errors, or problems encountered while completing the booked quest or regarding the validity of access codes or QR codes.
    3. SightQuest undertakes to remedy reported faults within a reasonable period of time. If it is not possible to remedy the fault within a reasonable period of time, SightQuest may, at its discretion, offer the customer a refund of the purchase price or alternative services, depending on the scope and severity of the fault in question.
    4. SightQuest is entitled to consult third parties contacted by the customer, provided this is expedient within the scope of contract fulfillment.
  6. Prices, payment terms, late payment
    1. The prices and other information provided on the website are subject to change and non-binding. The purchase price is due immediately after completion of the purchase.
    2. All prices are quoted in euros and include sales tax at the applicable statutory rate.
    3. If the customer defaults on payment, SightQuest is entitled to charge default interest at a rate of 12% per annum.
    4. At the point in time when the customer fails to meet their payment obligations, all outstanding claims against the customer become due in full immediately.
  7. Availability, warranty
    1. SightQuest strives to ensure the highest possible availability of the website and technical systems, but cannot guarantee continuous accessibility.
    2. SightQuest kann die Verfügbarkeit der Quest-Inhalte sowie deren technische Funktionalität nicht garantieren und haftet insbesondere nicht für die Erreichbarkeit der Webseite, wohl jedoch wird SightQuest im Fall von Störungen nach Maßgaben seiner Obliegenheiten und Kapazitäten auf die Behebung der Störung -- sofern möglich -- hinwirken.
    3. SightQuest reserves the right to temporarily restrict the availability of the website if this is necessary for maintenance, security, or system stability purposes.
    4. The services shall be deemed to have been approved by the customer and thus free of defects if the customer does not report a defect in writing within 14 days of the service being provided. If the customer fails to report the defect, they shall no longer be entitled to assert claims for warranty, compensation for the defect itself (damage caused by the defect) or for any error regarding the defectiveness of the service.
    5. If the customer is a consumer, the statutory warranty provisions apply.
    6. If the customer is an entrepreneur, SightQuest is entitled to determine the type of warranty (repair, replacement, price reduction) and its duration.
  8. Limitations of liability, compensation for damages
    1. SightQuest is liable in accordance with the standard of care of a prudent company, but not for slight negligence. This limitation of liability does not apply to personal injury.
    2. SightQuest accepts no liability for technical requirements on the part of the customer or for malfunctions, failures, or restrictions originating from the customer's sphere (in particular defective or unsuitable end devices, insufficient battery power, missing or unstable Internet or mobile phone connection, incorrect settings, or software conflicts). The customer is responsible for ensuring that their devices and access are suitable and functional for the use of SightQuest's services.
    3. The customer is responsible for paying close attention to their surroundings and ensuring their own safety, particularly with regard to traffic, construction sites, terrain, obstacles, and other local conditions. SightQuest accepts no liability in this regard.
    4. SightQuest shall not be liable for any damage caused by the customer's own fault, an unsafe environment, bad weather, improper use of the service, or failure to comply with local regulations.
    5. SightQuest accepts no liability for services provided by third parties, in particular public transport, museums, private institutions, or operators.
    6. The customer undertakes to inform themselves about all relevant local regulations, access conditions, and safety requirements prior to participation and to comply with them. SightQuest accepts no liability in this regard.
    7. If the customer is an entrepreneur, SightQuest shall not be liable for indirect damages, lost profits, lost interest, lost savings, consequential damages, pure financial losses, damages arising from third-party claims, nor for specific earnings or lost vacation enjoyment or any intangible damages that arise or may arise as a result of the non-performance of quests.
    8. Ist der Kunde Unternehmer, so wird im Falle einer Haftung von SightQuest das Verschulden -- entgegen den gesetzlichen Bestimmungen -- nicht vermutet, sondern hat der Kunde hierfür den Beweis zu erbringen.
    9. If the customer is an entrepreneur, claims for damages shall become time-barred within 6 months of knowledge of the damage and the party responsible for the damage.
  9. Copyright and rights of use
    1. All content, puzzles, texts, images, graphics, storylines, quests, etc. from SightQuest are protected by copyright.
    2. For the duration of the quest, the customer receives a non-exclusive, non-transferable, non-commercial right of use to utilize the content and images displayed to solve the quest.
    3. The publication, disclosure, or other transmission of the QR code, screenshots, and other content protected by SightQuest copyright (texts, solutions, puzzles, etc.) to third parties not party to the contract is strictly prohibited and constitutes a breach of contract. In this case, SightQuest reserves the right to claim damages, charge license fees, assert copyright infringements, and generally pursue violations both in court and under criminal law.
  10. Data protection
    1. SightQuest is committed to comprehensive data protection in accordance with the provisions of the GDPR and the Austrian Data Protection Act (DSG).
    2. SightQuest will use personal data exclusively for the intended purposes and will not undertake any commercial use or exploitation of this data beyond this scope.
    3. SightQuest undertakes to transfer all data protection obligations to employees, business partners, and subcontractors and guarantees their compliance.
    4. SightQuest's privacy policy is available on the website and the customer accepts its contents.
  11. Force majeure
    1. Force majeure is an external, unforeseeable event that cannot be averted even with the utmost care and which prevents the provision of services.
    2. In the event of force majeure that temporarily prevents SightQuest from providing its services, the obligation to perform shall be extended accordingly. This also applies analogously to the customer's obligations and responsibilities to cooperate.
  12. Subcontractors, prohibition of set-off
    1. SightQuest shall only be obliged to perform the services personally if this has been expressly agreed. Otherwise, SightQuest shall be entitled to engage assistants, subcontractors, or employees to perform the services at its own discretion.
    2. If the customer is an entrepreneur, any offsetting of claims for damages or other claims by the customer against SightQuest is excluded.
  13. Choice of law, place of jurisdiction
    1. The parties agree that Austrian law shall apply, excluding international referral rules and the UN Convention on Contracts for the International Sale of Goods.
    2. For all disputes arising from and in connection with the conclusion of the contractual relationship, the parties agree to the exclusive jurisdiction of the competent court in Vienna.
    3. If the customer is a consumer, the choice of law or the chosen place of jurisdiction may be subject to legal restrictions in the customer's country of residence. In the event that clauses 13.1 and 13.2 are invalid or restricted by mandatory law, the statutory provisions applicable to the contractual relationship with the customer shall apply.
  14. Final provisions
    1. Changes or additions to the contractual relationship are only effective if they are made in writing. This also applies to any waiver of the written form requirement.
    2. Should individual provisions of these General Terms and Conditions be invalid or unenforceable or become so as a result of a change in the legal situation, the validity of the remaining provisions shall remain unaffected. The parties undertake, by way of supplementary interpretation of the contract, to replace the invalid provision with a valid provision that comes as close as possible to the economic purpose of the invalid provision. The same applies mutatis mutandis to any gaps in this contract.
